Current VISA Sponsorship Issue: United States and Citizenship Services (USCIS) recently announced that significant H-1B processing delays are expected to begin on April 1st due to overwhelming H-1B CAP volume. While BVARI is exempt from the H-1B CAP, our H-1B petitions will be significantly affected by USCIS’ processing delays. Effect of USCIS’ processing delays: 1) H-1B Premium Processing will be SUSPENDED for approximately two weeks in the beginning of April, 2) Receipt notices for H-1B petitions filed in April will be issued after approximately one month, 3) All H-1B petitions are expected to be processed more slowly in the subsequent months and 4) Other visa sponsorship requests (TN, E-3, etc.) may also be processed more slowly.
New VISA Sponsorship Issue: There is an additional requirement for BVARI prior to making offers to any candidates requiring a VISA. As you know, there is a selection process and posting requirement for all position descriptions. BVARI asks that you document your decision, interview, and selection process for filling any position for such a candidate. The next step to this process requires that the selecting official must document a lack of US citizens which will require Nancy Watterson-Diorio and Dr. Terence Keane’s signature before an offer (either verbal or written) is processed. Please plan accordingly.
